At 3:28 in the morning on May 31, 2024, Monroe County Sheriff's Deputies were assisting the Rochester Police Department in their efforts to locate a suspect pursuant to an incident wherein a person was shot and the vehicle they were in was stolen approximately four hours earlier in the City of Rochester. The investigation led them to the 4800 block of West Henrietta Road in the Town of Henrietta where the stolen car was discovered. Accompanied by a man and a woman, the suspect entered the stolen vehicle and started to drive off. Deputies and RPD officers stopped the vehicle and detained all three occupants. A loaded .45 caliber Kimber handgun was discovered during the arrest. None of the individuals have a NYS pistol permit.

Jose Colon, 22, of Greece is charged with:

  • Criminal Possession of a Weapon in the Second Degree (Class C-Felony)
  • Criminal Possession of a Weapon in the Third Degree (Class D-Felony)
  • Criminal Possession of Stolen Property in the Third Degree (Class D-Felony)

Tyzion Z. Henry, 21, of Rochester is charged with:

  • Criminal Possession of a Weapon in the Second Degree (Class C-Felony)
  • Criminal Possession of Stolen Property in the Third Degree (Class D-Felony)

Madison Bergmann, 20, of Rochester is charged with:

  • Criminal Possession of a Weapon in the Second Degree (Class C-Felony)
  • Criminal Possession of Stolen Property in the Third Degree (Class D-Felony)

Jose Colon was arraigned in Rochester City Court and remanded to the Monroe County Jail without bail due to his predicate felon status. Additionally, Colon is on Parole for Assault in the second degree. Henry and Bergmann were arraigned in Henrietta Town Court and remanded to the Monroe County Jail. Henry is held on $2,500 cash bail and Bergmann was held on $250 cash bail. Bergmann posted her assigned bail and was released.
